Terms of Service

These Terms of Service ("Terms") govern your access to and use of NexCache Limited (Company Number 16831347) websites, products, and services ("Services"). By accessing or using the Services, you agree to these Terms.

Acceptance

If you do not agree to these Terms, do not use the Services. If you are using the Services on behalf of an organization, you represent that you have authority to bind that organization, and "you" refers to that organization.

Services

NexCache provides edge caching and related enterprise infrastructure solutions as described in applicable order forms, statements of work, or product documentation. Certain features may be subject to additional terms presented at the time of use or purchase.

We may modify, suspend, or discontinue any part of the Services with reasonable notice where practicable. We are not liable for any change, suspension, or discontinuance except as required by a separate written agreement.

Accounts

You may need to create an account to access certain Services. You agree to provide accurate information and to keep credentials confidential. You are responsible for activity under your account and must notify us promptly of unauthorized use.

Intellectual Property

The Services, including software, documentation, branding, and content we provide, are owned by NexCache or its licensors and are protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable right to use the Services in accordance with these Terms and any applicable agreement. You may not reverse engineer, copy except as permitted, or remove proprietary notices.

Acceptable Use

You agree not to misuse the Services, including attempting to gain unauthorized access, interfering with system integrity, or using the Services for unlawful purposes.

Limitation of Liability

To the maximum extent permitted by law, NexCache and its suppliers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or loss of profits, data, or goodwill. Our aggregate liability arising out of or related to the Services shall not exceed the greater of amounts you paid us in the twelve months before the claim or one hundred dollars (USD), except where liability cannot be limited by applicable law.

The Services are provided "as is" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

Termination

We may suspend or terminate your access to the Services if you violate these Terms or use the Services in a manner that could cause harm to NexCache or others.

Governing Law

These Terms are governed by the laws of the jurisdiction specified in your master agreement with NexCache, or if none is specified, by the laws applicable to NexCache principal place of business, without regard to conflict-of-law principles. Courts in that jurisdiction shall have exclusive venue, subject to mandatory consumer protections where applicable.
